Terms of Use — Phteah Yeay

These Terms of Use ("Terms") govern your use of phteahyeay.com and any subdomain operated by Phteah Yeay (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About us

The Site is owned and operated by Phteah Yeay, Thlok Andoung Village, Sangkat Slakram, Siem Reap City, Siem Reap, Cambodia. Ministry of Tourism Licence #[INSERT]. VAT TIN [INSERT]. Contact: hello@phteahyeay.com.

2. Use of the Site

You may use the Site to:

Read about Phteah Yeay, our rooms, our kitchen, and our activities
Make and manage a reservation
Sign up for our journal newsletter
Contact us about a booking, an event, or general inquiry

You may not use the Site to:

Attempt to access any account or area you are not authorised for
Reverse engineer, decompile, or otherwise interfere with the underlying code
Probe, scan, or test the security of the Site, except under a coordinated disclosure approved in writing by us
Scrape, harvest, or systematically copy our content for commercial purposes
Submit false information, including false bookings, false names, or stolen payment details
Use the Site to harass, defame, infringe, or harm any person, or to violate Cambodian or international law
Upload or transmit malware, viruses, or any code designed to disrupt the Site
Frame, embed, or otherwise present the Site as if it were your own

3. Account & booking responsibility

If you make a booking on the Site, you are responsible for keeping your booking-reference and login information confidential, providing accurate guest details, and complying with the Booking Agreement and House Rules. We may suspend or cancel a booking obtained through false information, fraud, or unauthorised account use.

4. Intellectual property

All content on the Site — text, photographs, illustrations, the wordmark, the Yeay figure, the layout, the code — is the property of Phteah Yeay or licensed to us. You may share links to public pages of the Site freely. For any other use (reproduction, distribution, adaptation, commercial republishing), please request written permission at hello@phteahyeay.com. Editorial press use is generally welcome — write to us first.

Trademarks: "Phteah Yeay", "ផ្ទះយាយ", "Phteah Yeay Siem Reap", "WELCOME HOME" (in the form used on this Site), and the temple-peak / seated-Yeay marks are trademarks of Phteah Yeay.

5. Third-party links

The Site contains links to third-party websites (booking partners, social media, mapping services, press mentions). We are not responsible for the content or privacy practices of those sites. Visiting them is at your own discretion.

6. Availability & accuracy

We work hard to keep the Site accurate, available, and free of errors, but:

Information may be incomplete or out of date — for example, room photographs taken before a renovation
The Site may be temporarily unavailable for maintenance, force majeure, or technical issues beyond our control
Booking calendar prices and availability are accurate at the moment shown, but the binding rate is the one confirmed in your booking confirmation email after deposit

If we discover an obvious pricing error (e.g., a USD 14,000 room priced at USD 14), we reserve the right to cancel an affected booking and refund any deposit in full.

7. Limitation of liability

To the maximum extent permitted by law, Phteah Yeay is not liable for any indirect, incidental, or consequential damages arising from your use of the Site, except in cases of gross negligence, wilful misconduct, or where exclusion is prohibited by law. Our aggregate liability arising from the Site (separate from any liability arising under the Booking Agreement) is limited to USD 100 or the lowest sum permitted by applicable law.

This limitation does not apply to:

Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Any other liability that cannot be excluded under Cambodian law or, for visitors resident there, the applicable consumer-protection laws of the EU/UK or US states

8. Reporting a security issue

If you find a security vulnerability in the Site, please report it responsibly to security@phteahyeay.com. We will respond within 7 days and will not pursue legal action against good-faith researchers who follow coordinated disclosure: don't access guest data beyond what's needed to demonstrate the issue, don't modify or destroy data, and give us a reasonable time to fix.

9. Copyright complaints (DMCA / WIPO)

If you believe content on the Site infringes your copyright, send a written notice to legal@phteahyeay.com with: identification of the copyrighted work, the URL of the infringing material, your contact details, a statement of good-faith belief, and a statement under penalty of perjury that you are authorised to act.

10. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent change. Material changes affecting your rights will be announced on the Site for 14 days before taking effect.

11. Governing law & jurisdiction

These Terms are governed by the laws of the Kingdom of Cambodia. Disputes shall be addressed first by amicable communication; if unresolved, by the competent courts of Cambodia or, by mutual written agreement, by mediation/arbitration through the National Commercial Arbitration Centre (NCAC).

For EU/UK consumer visitors, your statutory rights under your local consumer-protection laws remain available alongside these Terms.
